Layman's Guide to the SCOTUS Landmark decision to overturn Roe vs. Wade
Praise the LORD! Roe vs Wade has been overturned by the United States Supreme Court.
- Is abortion illegal now? No – Roe v. Wade was sort of like a federal abortion mandate. It prevented states from restricting abortion pre-viability. So now, states are free to set whatever abortion laws they see fit.
- Viability? Pre-Viability? In short, viability is the point at which a fetus is capable of living outside the womb with medical intervention. This is typically towards the end of the 2nd trimester (approx. 24 weeks). Roe vs Wade prevented states from outlawing these kinds of abortions.
- How did this happen? A case out of Mississippi called Dobbs v. Jackson Women’s Health was heard by the Supreme Court in December 2021. In short, Mississippi sought to restrict abortion at 15 weeks, and the case made it to the Supreme Court and directly challenged Roe’s phony viability standard.
- What will America look like? As mentioned, states are now free to set their own laws. States that are currently pro-abortion will continue to allow it (or double down in anger, probably), and states that are pro-life will restrict or ban abortion.
- Are other issues affected? No – rumors circulated about the effects of Roe’s reversal on other issues that hinge on “privacy rights,” such as gay marriage and even interracial marriage, but the Justices were very specific in the Dobbs opinion that this ruling only pertains to abortion.
- What do we do now? Now, we fight state battles, keep our eyes peeled at the federal level to stop any pro-abortion sneakiness in the wake of Roe, and double-down on building an infrastructure of real support for families that isn’t driven by government programs, but by local churches.
